Terms & Privacy

Plain-English placeholders for now — properly reviewed before Sbenza goes live.

Who we are

Sbenza (Pty) Ltd operates the Sbenza platform, connecting general workers with people and businesses who need them, in South Africa. We are not the employer of any worker on the platform — we provide the matching, payment and compliance tools that make hiring safer for everyone. [Draft — to be reviewed by an attorney before launch]

The escrow rules

When you fund a job, your payment is held in escrow by our payment gateway until you release it. Funds are released once you confirm the work is done to your satisfaction, or automatically refunded if a job is cancelled before it starts. Sbenza charges a platform fee of 8%, deducted from the worker's payout at the point of release, never charged twice. [Draft — to be reviewed by an attorney before launch]

Worker & employer responsibilities

Workers agree to represent their skills and experience honestly and to complete work they've accepted in good faith. Employers agree to fund jobs before work starts, to treat workers fairly and lawfully, and to release payment promptly once work is complete. Both parties are responsible for the accuracy of the information they provide. [Draft — to be reviewed by an attorney before launch]

Reviews

Both workers and employers may leave one honest review per completed engagement. Reviews should reflect genuine experience — we may remove reviews that are abusive, fraudulent or unrelated to the work performed. [Draft — to be reviewed by an attorney before launch]

Termination

We may suspend or close an account that breaches these terms, engages in fraud, or repeatedly attempts to take payment outside the platform to avoid escrow protection and fees. Users may close their own account at any time, subject to any engagements still in progress being settled first. [Draft — to be reviewed by an attorney before launch]

What we collect

To register and get you paid correctly, we collect your name, cellphone number, SA ID number, location (province, city, suburb, and GPS if you allow it), profile photos and, for workers, photos of past work.

Why we collect it

Your ID number and location are needed to generate accurate payslips and to file the legally required UIF contributions on your behalf — this applies even to short, casual and domestic work. Photos and write-ups help employers and workers find the right match nearby.

How it's protected

ID numbers are encrypted before they're stored. Uploaded ID documents are kept outside the public web folder and are only ever viewed by an authenticated admin checking a verification — they are never shown to other users, including employers or other workers.

Your rights

Under POPIA, you can ask us at any time to access the personal information we hold about you, correct anything that's wrong, or delete your account and associated data (subject to information we're legally required to keep, such as payslip and UIF records).
